| PHATBEATS MEDIA SERVICE DESCRIPTION |
| Phatbeats Media provides a service for professional DJ’s and MC’s to promote there selves on a platform via the web site of www.phatbeats.net/www.phatbeats.co.uk, www.FaceBook.com applications , www.MySpace.com Players , The I-Phone application , Other mobile phone brands via their local player with a coded address supplied by Phatbeats Media and a Tool bar downloaded on to internet users Internet explorer. |
| PHATBEATS MEDIA TERMS AND CONDITIONS. |
PAYMENTS |
| All payments for services must be in Pound sterling and should be paid with in 30 days of receiving each invoice. |
| SERVICES |
Customer is purchasing the service plan(s) described above. |
This Contract shall automatically renew on a monthly basis until notice is given to Phatbeats Media in writing terminate the contract, Customer will be assigned a user id and password to use the service. Customer shall have no rights in the user identification number or password and cannot obtain
such rights through usage, publication or otherwise. |
BILLING AND PAYMENT |
Pricing shall be valid during the monthly agreed contract only. Thereafter, prices may be adjusted from time to time upon thirty (30) days notice to Customer. |
Customer agrees to pay Phatbeats media for all services
used and all related charges at current Phatbeats media prices. |
Phatbeats Media shall provide Customer with a monthly / weekly invoice, for each Customer account, which shall account for all sums due arising from the provision of services. Customer shall pay recurring monthly plan fees in advance and all overages in arrears. Customer shall pay all invoices within 30 days of receipt of invoice. Any late payment invoices will be charged £5. |
BILLING DISPUTES |
Customer must notify Phatbeats media in writing or through the Accounts control panel of any disputed charges within thirty (30) days of the date of the bill containing
the disputed charges or Customer will have waived the right to dispute such charges. |
CHANGES TO TERMS AND CONDITIONS |
Except as otherwise expressly provided herein, Phatbeats Media may increase, reduce or otherwise
change any terms, conditions, rates, fees expenses, or charges regarding the service at any time. |
Phatbeats Media will provide the Customer with notice of such
changes (other than changes to governmental taxes, tariffs or surcharges) either in the monthly bill or separately, If Phatbeats Media increases charges under the Customer’s service plan. |
AVAILABILITY OF SERVICE |
Phatbeats Media does not guarantee uninterrupted service. Customer acknowledges that the quality, functionality and
availability of services may be affected by factors outside the control of Phatbeats Media and that occasionally, services may be suspended temporarily in order to modify, expand, maintain or repair system components. |
If service is interrupted for more than 30 minutes due to causes within Phatbeats Media’s control, Phatbeats Media may issue, upon request, a credit equal to a pro-rata adjustment of the weekly / monthly service fee for the time period that the service was unavailable, which will not exceed the monthly service fee. |
An interruption is measured from the time Customer reports it to Phatbeats Media. Phatbeats Media will require any credit request in writing within 24 hrs of the occurrence. Any instances should be directed to accounts@phatbeats.net |
SERVICE TERMINATION |
Either party may terminate the services at any time after the Service Commitment ends by giving at least thirty (30)
days notice to the other party. |
Phatbeats Media may terminate or interrupt service without notice for any conduct Phatbeats Media believes violates this Contract,
including, without limitation, the failure to pay when due any charges owed to Phatbeats Media, or, if the service is used in violation of applicable rules and regulations. |
NOTICE |
Any notice required hereunder shall be written and may be sent by fax or email (followed by a fax if Customer seeks to terminate service) at the contact information set forth for each party in the Quotation (unless such contact information is changed by notice as required hereunder). |
DAMAGES |
| Costs for any damages to the equipment or fixtures and fittings will be incurred by the person responsible and will be payable within 30 days from the event. |
| Should Phatbeats Media be unable to determine who is responsible for such damages to equipment, we may decide to split the costs between all clients of that particular studio. |

INSURANCE |
| All people visiting the premises need to make a contribution towards the insurance which covers us for employers and public liability and for theft of property. £10 per year will be collected from each DJ, MC, Guests and visitors before they are allowed access to any parts of the building. NO EXCEPTIONS |
| MISCELLANEOUS |
This Contract, including these Terms and Conditions, and the terms included in the service plan constitute the entire and complete agreement between Customer and Phatbeats Media, and supersede any and all prior agreements and understandings relating to the subject matter of this Contract. If any provision of this Contract is found to be unenforceable by a court or agency of competent jurisdiction, the remaining provisions will remain in full force and effect. |
| Phatbeats Media reserves the right to add, adapt or alter any parts of theses Terms at any time. |
